The Practice has been successful at appeal in establishing that a change of use to a self contained, first floor flat in London was immune from enforcement action. Evidence was gathered and submitted to show the use had commenced more than 4 years before the service of the Enforcement Notice. The Inspector agreed and quashed this part of the Notice. In addition, the Inspector granted planning permission for the change of use of the ground floor from residential to retail A1 use as part of the existing ground floor delicatessen.
