Listed Barn

Planning permission has been granted on appeal for a three-bed detached dwelling house following demolition of an existing pair of semi-detached properties and relocation of a (Grade II) listed barn in Woking, Surrey. The site was also situated within the Green Belt where Planning Policy Guidance Note No. 2 and Policies of the Local Plan impose strict constraints on development, but “very special circumstances” were considered to apply. Due to the complexity and confusion which now surrounds the Town and Country Planning (General Permitted Development) Order 1995 we are being asked to submit an increasing number of applications for lawful use certificates concerning extensions to houses, confirming that the proposals are permitted development and not requiring planning permission. Carter Planning can advise on whether or not planning permission is required for householder extensions and submit the appropriate applications to local planning authorities.

The replacement of a 1930s chalet in the Berkshire Green Belt with a modern house has been welcomed by an Appeal Inspector who considered that the simple modernist-style and sustainable design would have well balanced fenestration with a dominance of solid over void enlivened by a first floor balcony. The new building to be built in white render and zinc roofing, was altogether a “good contemporary design”.

Planning permission has been granted on appeal for 10 semi-detached houses in south west London. The site was formed from private gardens and, notwithstanding last years changes to Planning Policy Statement 3 which meant this was no longer regarded as previously developed land, the site was nevertheless in a sustainable location and a residential area and the layout was an acceptable one. The Practice has obtained consent to demolish an existing house in a Conservation Area and Area of Special Residential Character in Surrey and planning permission for a replacement house designed in the Arts and Crafts style with a distinctive, steeply sloping hipped roof and dormers. The change of use of land for a tennis court and ancillary fencing has been granted in the Chilterns Area of Outstanding Natural Beauty. The site, which also adjoined a Grade II Listed Building, was located in a prominent elevated position in the countryside but was considered acceptable if it was comprehensively landscaped. Listed building consent and planning permission has been obtained to convert two buildings containing offices in Barnsbury Conservation Area, Islington, London into eight flats. It was considered that the scheme would preserve the historic heritage, would not lead to the unjustified loss of employment opportunities and would provide adequate amenities for future occupiers of the flats. Temporary planning permission has been granted, and an enforcement notice quashed, for a 300 seat wedding venue marquee in the grounds of a Grade 1 Listed Building in Berkshire. The Planning Inspector concluded that any harm to the setting of the building was not significant and that the income generated helped to maintain the important Listed Building - Baylis House

The replacement of a builders yard in the Surrey Green Belt with alternative schemes for two houses and two bungalows has been allowed on appeal. The Inspector commented that the Council did not have a five year supply of housing land and that the living conditions of neighbours, and the character and appearance of the area would be materially improved.
